Terms and conditions for Companies

1. DEFINED TERMS

Career platform – refers to the section in our webpage that send you to our recruitment site, a platform (hereinafter referred to as "Career Platform") created and managed by Playful Software SRL, a limited liability company headquartered in Bucharest, 10 Glicinelor Street, registered at the Trade Register under no. J40/2950/2016, Tax Registration Code 35728130. 

The undersigned I FUTURE NXT S.R.L, Romanian legal person, registered at the Trade Register under no. J40/12347/2011, VAT registration number CUI 29233349, bank account   RO88INGB0001008199458910 opened at ING Bank N.V. Amsterdam - Bucharest Branch, with the registered office at Splaiul Independentei, No. 319-C, Building A, Mezzanine, No. 2, District 6, Bucharest, hereby confirms that we hold a valid license of the Platform which we store it on our internal servers.

Employers – natural person / legal entity or any entity that creates an account for employers on the Career Platform;

User – any natural person, also called a “player” or “candidate” who creates an Account on the Site in order to create an employee profile and participate in the tests and games on the Career Platform;

Account – the section of the Career Platform consisting of an e-mail address, password and username which allows the User to participate in tests and gamification games on the Website and which contains information about the User, such as the User’s history on the Career Platform;

Website/Career Platform – the website accessible at the URL https://careers.ifuture.eu/ , including its subdomains,;

Services – any service to be provided by I Future to the Users based on these Terms and Conditions;

Campaign – the act of displaying, for commercial purposes, a finite number of Services for a limited period of time set by I Future ;

Content – all the information on the Website that can be visited, viewed, or otherwise accessed using electronic equipment:

• the content of any e-mail sent to the User by  I Future through electronic means and/or any other available means of communication;
• any information communicated by any means by an employee/collaborator of I Future , to the User, according to the contact information, specified or not;
• information related to the Services or tariffs practiced by I Future in a certain period;
• information related to the Services and tariffs used by a third party with which I Future  has concluded partnership, collaboration or service contracts, in a certain period;
• data relating to I Future or other privileged data thereof;
• data on news, tests and games available or under development by I Future ;

Profile – all the data related to the results of tests and games, as well as those completed by the User in their personal profile, to which the Employer could have access;

Newsletter – means of information, available periodically, exclusively electronic, respectively electronic mail, on the Services and / or promotions carried out by I Future in a certain period, without any commitment on the part of I Futurewith reference to the information contained therein;

Results/Skills assessment – the set of results obtained by the Users following the tests and games which will be displayed in the User’s Profile;

Games and tests – the set of items leading to the Skills Assessment of Candidates.

 

2. CONTRACTUAL DOCUMENTS

• By registering an Account on the Website, the User agrees with the form of communication (telephone or e-mail) through which I Future carries out its commercial operations.
• When opening the User account on the I Future Career Platform, the User will confirm that he agrees with these Terms and Conditions. The User's agreement to the Terms and Conditions is required for providing the Services. 
• The contractual agreement is considered concluded between I Future and the User at the time of receipt by the User from I Future l, by e-mail, of the notification confirming the opening of the account.

 

3. CREATING THE USER ACCOUNT

• Access for the purpose of placing an Order is allowed to any User following the validation of the Account.
• For justified reasons, I Future reserves the right to restrict Users’ access  register the Account, place an Order and/or some of the accepted payment methods if it considers that as a result of the conduct or activity of the User it may be harmed in any way. In such a situation, the User may contact I Future in order to be informed of the reasons that led to the application of such measures by sending an e-mail to the address indicated in the "Contact" section of the Career Platform .
• For security reasons, I Future reserves the right to ask Users to confirm the CAPTCHA validation, in order to protect the information and traffic on the Site.

 

4. ASSIGNMENT AND SUBCONTRACTING

• I Future may assign and/or subcontract to a third party for Services related to Games and evaluation tests through an embedded system within the Career Platform.
• In case of access to the Services of a third party, it will be solely responsible for fulfilling the obligations assumed towards the Users.
• More details may be found on the Privacy Policy section.

 

5. INTELLECTUAL AND INDUSTRIAL PROPERTY LAW

• The content, as defined in section 1 above, including but not limited to logos, stylized representations, commercial symbols, still images, dynamic images, text and/or multimedia content presented on the Website, are the exclusive property of I Future, to whom all rights obtained for this purpose are reserved directly or indirectly (through licenses for use and/or publication).
• The User is not allowed to copy, distribute, publish, transfer to third parties, modify and/or otherwise alter use, link to, expose, include any Content in any context other than the original one intended by I Future, the inclusion of any Content outside the Website, the removal of signs that signify I Future's copyright over the Content, as well as participation in the transfer, sale, distribution of materials made by reproducing, modifying or displaying the Content, except with the express wrote consent of I Future.
• The User may copy, transfer and/or use Content only for personal or non-commercial purposes, only if they do not conflict with the provisions of this regulation.
• If I Future grants the User the right to use in the form described in a separate user agreement, certain content, to which the User has or obtains access as a result of this agreement, this right extends only to that or those contents defined in the agreement, only during the period of its existence or these contents on the Career Platform  or the period defined in the agreement, according to the defined conditions, if they exist and do not represent a contractual commitment from I Future for that User or any other third party who has / obtains access to this transferred content, by any means and which could be or is harmed in any way as a result of this content, during or after the expiration of the user agreement.
• No Content transmitted to the User, by any means of communication (electronic, telephone etc.) or acquired by him by accessing, visiting and / or viewing it constitutes a contractual obligation on the part of I Future and / or the employee / agent of I Future who mediated the transfer of Content, if any, to such Content.
• Any use of the Content for purposes other than those expressly permitted by this Agreement or the accompanying user agreement, if any, is prohibited.

 

6. ORDERS AND PAYMENTS

• The User can make Orders through the Website by which he purchases Services from the Career Platform on a subscription basis. "Order" means the firm request of a User, in the form of an electronic document, by which, through the Website, its intention to purchase the Services offered by I Future on a subscription basis is transmitted to I Future.
• The subscription purchased on the basis of the order will be extended until termination. I Future can offer a number of subscription plans, including special promotional plans. Some subscription plans may have different conditions and limitations, which are disclosed at the time of registration or through other messages that are addressed to the User.
• In order to use the I Future service, you must provide us with one or more Payment Methods. "Payment Method" means a current, valid and accepted payment method that may be updated from time to time and may include payment through your third party account. If you do not cancel the subscription before the billing date, you authorize us to charge the subscription fee for the next billing period through the selected Payment Method.
• By completing the Order, the User agrees that all data provided by him is correct, complete and true at the date of placing the Order.
• By completing the Order, the User agrees that I Future may contact him, by any means available / agreed by I Future, in any situation where it is necessary to contact him.
• The I Future Career Platform subscription can start with a free trial period. The free trial period of the subscription will be specified during the registration process and is intended to allow Users to test the services offered by I Future  on an Order basis. Eligibility for the free trial period remains at the sole discretion of I Future and the eligibility or duration of the probationary period may be limited to prevent its misuse.
• At the end of the free trial period, I Future will charge the subscription fee for the next billing period through the selected Payment Method, unless the User cancels the subscription before the expiration of the free trial period.
• I Future may cancel the Order placed by the User / Client, following a prior notification addressed to him, without any subsequent obligation of any party to the other or without any party being able to claim damages from the other in the following case:
• non-acceptance by the issuing bank of the User / Client card for the transaction;
• invalidation of the transaction by the card processor approved by  I Future;
• the data provided by the User / Client on the Website is incomplete and / or incorrect;
• violation of any of the provisions of these Terms and Conditions.
• Given that I Future  provides through the Career Platform digital content that is not delivered on a material medium, the User confirms that he gives his express consent to the provision of services by placing an Order and understands that he will not have the right to withdraw from the contract. The User will be able to cancel his subscription to I Future Career Platform services at any time.
• The User can cancel the Career Platform subscription at any time and will continue to have access to the Platform until the end of the billing period. Payments are non-refundable and I Future Career Platform does not offer refunds or credits for subscription periods started. To cancel the subscription, the User will access the section related to the User Account in the Platform and will follow the cancellation instructions. The User Account will automatically close at the end of the current billing period.
• The prices of the Services displayed within https://careers.ifuture.eu/ include VAT according to the legislation in force.
• The price, payment method and payment term are specified in each Order. I Future will issue to the User / Client an invoice for the Services, their obligation being to provide all the information necessary to issue the invoice in accordance with the legislation in force.
• I Future will send to the Users the invoices related to the Order, exclusively in electronic format, by adding the invoices in the User's Account or by e-mail, to the e-mail address mentioned in their Account.
• For a correct communication of invoices, the User has the obligations to update whenever necessary the data from his Account and to access the information and documents related to each Order, available in the Account.

 

7. CONFIDENTIALITY

• I Future will maintain the confidentiality of any information you provide. Disclosure of the information provided may be made only under the conditions set forth in these Terms and Conditions.
• By submitting information or materials through this Career Platform, you offer I Future unrestricted and irrevocable access to them, the right to use, reproduce, display, modify, transmit and distribute such materials or information. You also agree that I Future may freely use, in its own interest, such information, ideas, concepts, know-how or techniques that you have sent to us through the Career Platform. I Future will not be subject to obligations regarding the confidentiality of the information sent, if there is  a legal requirement that may provide other specifications in this regard.

 

8. PUBLICITY

• I Future newsletters are sent by our Career Platform. This ensures the confidentiality and security of information.
• When the User creates an Account on the Career Platform, he has the possibility to express his agreement regarding the receipt of Newsletters.
• The User may change his option regarding the agreement issued to I Future at any time:
• by contacting I Future in this regard;
• by changing the settings in the User Account in the "My Account" section;
• by accessing the unsubscribe link displayed in the commercial messages received from I Future Career Platform.
• Waiver of receipt of Newsletters does not imply waiver of acceptance of these Terms and Conditions.

 

9. LIABILITY

• By creating and using the Account, the User assumes responsibility for maintaining the confidentiality of Account data (user and password) and for managing access to the Account, and, to the extent permitted by the applicable law, is responsible for the activity carried out through his Account.
• By creating the Account and/or using the Content, the User expressly and unequivocally accepts the Terms and Conditions of the Website in the latest updated version that is communicated within the Website, available at the date of creating the Account and/or using the Content and/or date of placing the Order.
• After creating the Account, the use of the Content is equivalent to accepting the changes made to the Website Terms and Conditions and/or the updated versions of the Website Terms and Conditions.
• The Terms and Conditions of the Site may be modified at any time by I Future, being opposable to the User from the date of their posting on the Website. Acceptance of the Career Platform  Terms and Conditions is confirmed by checking the appropriate checkbox on the Website.

 

10. USERS’ OBLIGATIONS

• I Future has the right to modify, delete, close or suspend the accounts of the Users of the Career Platform , without prior notice, without any compliance deadline and without other formalities, if the User does not comply with the following prohibitions and obligations:
• To provide real, correct and complete information during the registration and updating of Account details;
• Not to publish, transmit or display any material or information through which goods or services are promoted, regardless of their nature;
• Not to publish any unsolicited commercial messages or spam;
• Not to publish or transmit any kind of message which is offensive, threatening, indecent, discriminatory or which may violate the rights of other third parties;
• Not to use applications, programs or commands made through code sequences, which may suspend, interrupt, alter or remove one or more of the functions of the Website, regardless;
• Users declare that they will be solely responsible for the breach of these obligations and that they will cover any damage suffered by another user or third parties who could claim damages caused by these violations.

 

11. THE PROCESSING OF PERSONAL DATA

• I Future seeks to protect as much as possible the right to privacy and the image of the Website’s users. I Future's intention is to provide a safe online experience that will not adversely affect your personal life. In this regard, I Future makes every effort to ensure that the information you enter into our database is used exclusively for your intended purposes.
• At the time of registration on the Career Platform  by creating an Account, by accessing it, I Future will process personal information likely to identify a particular person in accordance with these Terms and Conditions and for the purpose stated in I Future's Privacy Policy. You should read this policy to understand what personal data we collect and for what purposes we use it.

 

12. FORCE MAJEURE

• Neither party shall be liable for non-performance of its contractual obligations if such failure to perform on time and / or properly, in whole or in part, is due to a force majeure event. Force majeure is an unpredictable event, beyond the control of the parties and which cannot be avoided.
• If within 15 (fifteen) days from the date of its occurrence, the respective event does not cease, each party will have the right to notify the other party of the full termination of the contractual relationship without any of them being able to claim damages from the other.

 

13. APPLICABLE LAW - JURISDICTION

• These Terms and Conditions are governed by the laws of Romania.
• If it is not possible to resolve disputes amicably, the User may bring claims before the competent courts in Bucharest, in which case the Romanian language version of the Terms and Conditions shall prevail.

1.           DEFINIȚII ȘI ÎNȚELESUL UNOR TERMENI

Platforma de cariere – se referă la secțiunea din pagina noastră web care vă trimite pe site-ul nostru de recrutare, o platformă (denumită în continuare "Platforma carierei") creată și administrată de PLAYFUL SOFTWARE SRL, societate cu răspundere limitată cu sediul în București, strada Glicinelor nr. J40/2950/2016, Cod înregistrare fiscală 35728130.

Subscrisa I FUTURE NXT S.R.L, persoană juridică română, înregistrată la Registrul Comerțului sub nr. J40/12347/2011, număr de înregistrare TVA CUI 29233349, cont bancar RO88INGB0001008199458910 deschis la ING Bank N.V. Amsterdam - Sucursala Bucuresti, cu sediul social la Splaiul Independentei, Nr. 319-C, Cladirea A, Mezanin, Nr. 2, Sector 6, Bucuresti, confirma prin prezenta ca detinem o licenta valabila a Platformei pe care o stocam pe sau pe servere interne.

Angajatori – persoana fizică/ persoana juridică sau orice entitate care își creează un cont destinat angajatorilor în Site;

Utilizator – orice persoană fizică, denumită și „jucător” sau „candidat” care își creează un Cont în Site în vederea creării unui profil de angajat și participarea la testele și jocurile din cadrul Site-ului;

Cont – secțiunea din Site formata dintr-o adresa de e-mail, parola și username care permite Utilizatorului participarea la testele și jocurile de gamification din Site și care conține informații despre Utilizator, respectiv istoricul Utilizatorului in Site.

Site/Platforma de Cariere – website-ul accesibil la adresa URL https://careers.ifuture.eu/, inclusiv subdomeniile acestuia.

Servicii – orice serviciu care urmează a fi furnizate de către I Future către Utilizator în baza acestor Termeni și Condiții;

Campanie – acțiunea de a expune in scop comercial, un număr finit de Servicii pentru o perioada limitata de timp stabilita de către I Future.

Conținut - toate informațiile de pe Site care pot fi vizitate, vizualizate sau altfel accesate prin utilizarea unui echipament electronic;

o   conținutul oricărui e-mail trimis Utilizatorilor de către I Future prin mijloace electronice si/sau orice alt mijloc de comunicare disponibil;

o   orice informație comunicata prin orice mijloc de către un angajat/colaborator al I Future, Utilizatorilor, conform informațiilor de contactare, specificate sau nu de către acesta;

o   informații legate de Serviciile sau tarifele practicate de I Future într-o anumita perioada;

o   informații legate de Serviciile sau tarifele practicate de către un terț cu care I Future are încheiate contracte de parteneriat, colaborare sau prestări Servicii, într-o anumita perioada;

o   date referitoare la I Future, sau alte date privilegiate ale acestuia;

o   date referitoare la noutăți, teste și jocuri disponibile sau aflate în dezvoltare de I Future.

Profil – toate datele referitoare la rezultatele testelor și jocurilor și completarea profilului personal de către Utilizator, la care un Angajator ar putea avea acces.

Newsletter – mijloc de informare periodic, exclusiv electronic, respectiv posta electronica asupra Serviciilor si/sau a promoțiilor desfășurate de I Future într-o anumita perioada, fără niciun angajament din partea I Future cu referire la informațiile conținute de acesta.

Rezultate/Evaluarea competențelor – ansamblul de rezultate obținute de Utilizatori în urma testelor și jocurilor ce vor fi afișate în Profilul Utilizatorului;

Jocuri și teste – ansamblul de elemente ce conduc la Evaluarea competențelor Utilizatorilor;

2.           DOCUMENTE CONTRACTUALE

2.1.      Prin înregistrarea unui Cont pe Platforma de Cariere, Utilizator este de acord cu forma de comunicare (telefonic sau e-mail) prin care I Future își derulează operațiunile comerciale.
2.2.      La deschiderea contului de Utilizator pe platforma de cariere I Future, Utilizatorul va confirm că este de acord cu acești Termeni și Condiții. Acordul Utilizatorului pentru Termeni și Condiții este necesar pentru prestarea Serviciilor.
2.3.      Acordul contractul se considera încheiat intre I Future si Utilizator in momentul primirii de către Utilizator de la I Future, prin intermediul poștei electronice a notificării de confirmare a deschiderii contului.

3.           CREEAREA CONTULUI DE UTILIZATOR

3.1.      Accesul ii este permis oricărui Utilizator în urma validării Contului.
3.2.      Pentru motive justificate, I Future își rezervă dreptul de a restricționa accesul Utilizatorilor în vederea înregistrării Contului, în cazul în care consideră că în baza conduitei sau activității Utilizatorului ar putea prejudicia în vreun fel I Future. Într-o astfel de situație, Utilizatorul se poate adresa I Future pentru a fi informat cu privire la motivele care au condus la aplicarea acestor măsuri, prin e-mail indicate în secțiunea „contact” din Site.

4.           CESIONAREA SI SUBCONTRACTAREA

4.1.      I Future poate cesiona si/sau subcontracta o terță parte pentru Servicii ce țin de testare și jocuri prin sistem de embeding în cadrul Platformei de Cariere.
4.2.      În cazul accesului la Serviciile unei terțe persoane, aceasta va fi unica răspunzătoare de îndeplinirea obligațiilor asumate față de Utilizatori.

5.           DREPTUL DE PROPRIETATE INTELECTUALA SI INDUSTRIALA

5.1.      Conținutul, astfel cum este definit in preambul, incluzând dar nelimitând-se la logo-uri, reprezentări stilizate, simboluri comerciale, imagini statice, imagini dinamice, text si/sau conținut multimedia prezentate pe Site, sunt proprietatea exclusiva a I Future, acestuia fiindu-i rezervate toate drepturile obținute in acest sens in mod direct sau indirect (prin licențe de utilizare si/sau publicare).
5.2.      Utilizatorului nu ii este permisa copierea, distribuirea, publicarea, transferul către terțe părți, modificarea si/sau altfel alterarea, utilizarea, legarea la, expunerea, includerea oricărui Conținut in orice alt context decât cel original intenționat de I Future, includerea oricărui Conținut in afara Site-ului, îndepărtarea însemnelor care semnifica dreptul de autor al I Future asupra Conținutului precum si participarea la transferul, vânzarea, distribuția unor materiale realizate prin reproducerea, modificarea sau afișarea Conținutului, decât cu acordul scris expres al I Future.
5.3.      Utilizatorul poate copia, transfera si/sau utiliza Conținut numai in scopuri personale sau non-comerciale, numai in cazul in care acestea nu intra in conflict cu prevederile prezentului regulament.
5.4.      In cazul in care I Future conferă Utilizatorului dreptul de a utiliza sub forma descrisa într-un acord de utilizare distinct, un anumit conținut, la care Utilizatorul are sau obține acces in urma acestui acord, acest drept se extinde numai asupra acelui sau acelor conținuturi definite in acord, numai pe perioada existentei acestuia sau acestor conținuturi pe site sau a perioadei definite in acord, conform condițiilor definite, in cazul in care acestea exista si nu reprezintă un angajament contractual din partea I Future pentru respectivul Utilizator sau oricare alt terț care are/obține acces la acest conținut transferat, prin orice mijloc si care ar putea fi sau este prejudiciat in orice mod de pe urma acestui conținut, in timpul sau după expirarea acordului de utilizare.
5.5.      Niciun Conținut transmis către Utilizator, prin orice mijloc de comunicare (electronic, telefonic, etc) sau dobândit de acesta prin accesare, vizitare si/sau vizualizare nu constituie o obligație contractuala din partea I Future si/sau al angajatului/prepusului I Future care a mijlocit transferul de Conținut, in cazul in care aceasta exista, fata de respectivul conținut.
5.6.      Este interzisa orice utilizare a Conținutului in alte scopuri decât cele permise expres prin prezentul acord sau de acordul de utilizare care îl însoțește, in cazul in care acesta exista.
5.7.      prezentul acord sau de acordul de utilizare care îl însoțește, in cazul in care acesta exista.

6.           COMENZI ȘI PLĂȚI

6.1.      Utilizatorul poate efectua Comenzi prin Site prin care achiziționează servicii de pe Platformă pe bază de abonament. „Comandă” înseamnă solicitarea fermă a unui Utilizator, sub forma unui document electronic, prin care se transmite către I Future, prin intermediul Site-ului, intenția sa de a achiziționa Serviciile oferite de I Future  contra-cost pe bază de abonament.
6.2.      Abonamentul achiziționat în baza comenzii se va prelungi până la reziliere. I Future  poate oferi o serie de planuri de abonament, inclusiv planuri promoționale speciale. Unele planuri de abonament pot avea condiții și limitări diferite, acestea fiind dezvăluite în momentul înregistrării sau prin intermediul altor mesaje care sunt adresate Utilizatorului.
6.3.      Pentru a folosi serviciul I Future , trebuie să ne furnizezi una sau mai multe Metode de Plată. „Metodă de Plată” înseamnă o metodă de plată actuală, valabilă și acceptată, care poate fi actualizată ocazional și care poate include plata prin intermediul contului tău cu o terță parte. Dacă nu anulezi abonamentul înainte de data de facturare, ne autorizezi să percepem tariful aferent abonamentului pentru perioada următoare de facturare prin Metoda de Plată selectată.
6.4.      Prin finalizarea Comenzii Utilizatorul consimte ca toate datele furnizate de acesta sunt corecte, complete si adevărate la data plasării Comenzii.
6.5.      Prin finalizarea Comenzii, Utilizatorul consimte ca I Future  poate sa îl contacteze, prin orice mijloc disponibil / agreat de I Future , in orice situație in care este necesara contactarea acestuia.
6.6.      Abonamentul I Future  poate începe cu o perioadă de testare gratuită. Perioada de testare gratuită a abonamentului va fi specificată în timpul procesului de înregistrare și are scopul de a permite Utilizatorilor să testeze serviciile oferite de I Future  pe baza de Comandă. Eligibilitatea pentru perioada de testare gratuită rămâne la latitudinea exclusivă a I Future  și eligibilitatea sau durata perioadei de testare poate fi limitată pentru a preveni folosirea abuzivă a acesteia.
6.7.      La finalul perioadei de testare gratuită, I Future  va percepe tariful aferent abonamentului pentru perioada următoare de facturare prin Metoda de Plată selectată, cu excepția situației în care Utilizatorul anulează abonamentul înainte de expirarea perioadei de testare gratuită.
6.8.      I Future  poate anula Comanda efectuata de către Utilizator/Client, in urma unei notificări prealabile adresate acestuia, fără nicio obligație ulterioara a vreunei părți fata de cealaltă sau fără ca vreo parte sa poată sa pretindă celeilalte daune-interese in următoarele cazuri:
6.8.1. neacceptarea de către banca emitenta a cardului Utilizatorului/Clientului, a tranzacției;
                invalidarea tranzacției de către procesatorul de carduri agreat de I Future ;
                datele furnizate de către Utilizator/Client, pe Site sunt incomplete si/sau incorecte;
6.8.2. în cazul încălcării oricăreia din prevederile acestor termeni și condiții.
6.9.      Având în vedere că I Future  furnizează conținut digital care nu este livrat pe un suport material, Utilizatorul confirmă că își dă acordul expres pentru prestarea serviciilor prin plasarea unei Comenzi și înțelege că nu va avea dreptul de retragere din contract. Utilizatorul va putea să anuleze în orice moment abonamentul sau la serviciile I Future .
6.10.  Utilizatorul poate  anula abonamentul I Future  oricând și va continua să aibă acces la Platformă până la finalul perioadei de facturare. Plățile nu sunt rambursabile și I Future  nu oferă rambursări sau credite pentru perioadele de abonament începute. Pentru a anula abonamentul, Utilizatorul va accesa secțiunea aferentă contului de utilizator din Platforma și va urma instrucțiunile de anulare. Contul de Utilizator se va închide automat la finalul perioadei curente de facturare.
6.11.  Prețurile Serviciilor afișate în cadrul www.I Future .io includ TVA conform legislației în vigoare.
6.12.  Prețul, modalitatea de plata si termenul de plata sunt specificate in fiecare Comanda. I Future  va emite către Utilizator/Client o factura pentru Servicii, obligația acestora fiind sa furnizeze toate informațiile necesare emiterii facturii conform cu legislația in vigoare.
6.13.  I Future  va transmite Utilizatorilor facturile aferente Comenzii, exclusiv in format electronic, prin adăugarea facturilor in Contul Utilizatorului sau prin poștă electronică, la adresa de e-mail menționată în Contul său.
6.14.  Pentru o corectă comunicare a facturilor, Utilizatorului îi revin obligațiile de a-și actualiza ori de câte ori este cazul datele din Contul său și de a accesa informațiile și documentele aferente fiecărei Comenzi, existente in Cont.
 
7.           CONFIDENTIALITATE

7.1.      I Future va păstra confidențialitatea informațiilor de orice natura pe care le furnizați. Dezvăluirea informațiilor furnizate se va putea face doar in condițiile menționate in prezentul acord.
7.2.      Prin transmiterea de informații sau materiale prin intermediul Platformei de Cariere, oferiți I Future acces nerestricționat si irevocabil la acestea, dreptul de a utiliza, reproduce, afișa, modifica, transmite si distribui aceste materiale sau informații. Sunteți, de asemenea, de acord ca I Future sa poată utiliza liber, in interes propriu, aceste informații, idei, concepte, know-how-uri sau tehnici pe care ni le-ați trimis prin intermediul Platformei de Cariere.  I Future nu va constitui subiect de obligații referitoare la confidențialitatea informațiilor trimise, daca legislația in vigoare nu prevede alte specificări in acest sens.

8.           PUBLICITATE

8.1.      Newsletterele I Future sunt transmise de Platfoma de Cariere. Astfel, sunt asigurate confidențialitatea si securitatea informațiilor.
8.2.      In momentul in care, Utilizatorul își creează un Cont pe Site, are posibilitatea sa își exprime acordul cu privire la primirea de Newslettere.
8.3.      Utilizatorul își poate modifica opțiunea cu privire la acordul emis către I Future in orice moment:
8.3.1. prin contactarea I Future in acest sens.
8.3.2. prin modificarea setărilor din Contul de utilizator la secțiunea „Contul meu”.
8.3.3. prin accesarea link-ului de dezabonare afișat in mesajele comerciale primite de la I Future.
8.4.      Renunțarea la primirea Newslettere-lor nu implica renunțarea la acceptul dat pentru prezentul acord.

9.           RĂSPUNDERE

9.1.      Prin crearea si utilizarea Contului, Utilizatorul își asuma răspunderea pentru menținerea confidențialității datelor de Cont (user si parola) si pentru gestionarea accesării Contului, și, în măsura permisa de legislația in vigoare, este responsabil de activitatea derulata prin intermediul Contului sau.
9.2.      Prin crearea Contului si/sau utilizarea Conținutului, Utilizatorul accepta in mod expres si fără echivoc Termenii si condițiile Site-ului in ultima versiune actualizata care este comunicata in cadrul Site-ului, existenta la data creării Contului si/sau utilizării conținutului si/sau la data plasării Comenzii.
9.3.      Ulterior creării Contului utilizarea Conținutului echivalează cu acceptarea modificărilor intervenite asupra Termenilor si Condițiilor Site-ului si/sau a versiunilor actualizate ale Termenilor si Condițiilor Site-ului.
9.4.      Termenii si Condițiile Site-ului pot fi modificați oricând de către I Future, aceștia fiind opozabili Utilizatorul de la data afișării in Site. Acceptarea Termenilor si Condițiilor Site-ului se confirma prin bifarea casetei  corespunzătoare din Site.

10.        OBLIGAȚIILE UTILIZATORILOR

10.1.  I Future are dreptul de a modifica, șterge, închide sau suspenda conturile Utilizatorilor site-ului, fără o notificare prealabilă, fără vreun termen de conformare și fără alte formalități, dacă Utilizatorul nu respectă următoarele interdicții și obligații:
10.1.1.      Să ofere informații reale, corecte și complete în cadrul înregistrării si actualizării detaliilor contului;
10.1.2.      Să nu publice, transmită sau afișeze orice material sau informație prin care să se promoveze bunuri sau servicii, indiferent de natura acestora;
10.1.3.      Să nu publice nici un fel de mesaj comercial sau spam nesolicitat;
10.1.4.      Să nu publice sau transmită orice fel de mesaj jignitor, amenințător, indecent, discriminatoriu sau care poate încălca drepturile altor terțe persoane;
10.1.5.      Să nu utilizeze aplicații, programe sau comenzi efectuate prin secvențe de cod, de natură a suspenda, întrerupe, altera sau elimina una sau mai multe din funcțiile site-ului, indiferent;
10.2.  Utilizatorii declară că vor fi unicii responsabili pentru încălcarea acestor obligații și că vor acoperi orice prejudiciu suferit de alt utilizator sau terțe persoane care ar putea pretinde daune cauzate de aceste încălcări.

11.        PRELUCRAREA DATELOR CU CARACTER PERSONAL

11.1.  I Future încearcă sa protejeze cat mai mult posibil dreptul privind confidențialitatea si imaginea utilizatorilor Site-ului. Intenția noastră este aceea de a va oferi in calitate de Utilizator al Site-ului, o experiență online sigură, care nu vă va afecta negativ viață personală. În acest sens, depunem toate eforturile necesare pentru a ne asigura ca informațiile pe care le introduceți in baza noastră de date sunt utilizate exclusiv in scopurile gândite de dvs.
11.2.  Când vă înregistrați pe Site prin crearea unui cont, prin accesarea acestuia, I Future va prelucra informațiile cu caracter personal de natura sa identifice o anumita persoana in concordanta cu termenii si in scopul declarat stipulat in Politica de confidențialitate a I Future. Trebuie sa citiți aceasta politica pentru a înțelege ce date personale colectam si in ce scopuri le utilizăm.

12.        FORTA MAJORA

12.1.  Niciuna din părți nu va fi răspunzătoare pentru neexecutarea obligațiilor sale contractuale, daca o astfel de neexecutare la termen si/sau in mod corespunzător, total sau parțial este datorata unui eveniment de forță majoră. Forța majora este evenimentul imprevizibil, in afara controlului părților și care nu poate fi evitat.
12.2.  Daca în termen de 15 (cincisprezece) zile de la data producerii lui, respectivul eveniment nu încetează fiecare parte va avea dreptul sa notifice celeilalte părți încetarea de plin drept a relației contractuale fără ca vreuna dintre ele sa poată pretinde celeilalte alte daune-interese.

13.        LEGEA APLICABILA – JURISDICTIA

13.1.  Acești Termeni si Condiții sunt guvernați de legile din Romania.
13.2.  In cazul in care nu este posibila rezolvarea litigiilor pe cale amiabila, Utilizatorul se poate adresa instanțelor judecătorești competente din București, caz in care versiunea in limba romana a Termenilor si Condițiilor va prevala.
